The Board of directors or the Bonvue Irrigation Association does hereby notify all members in writing that the Regulations stated below shall be enacted for the 2005 watering season and hereafter, until changes are made by the Board of directors, as may be deemed necessary.
REGULATIONS
- Only the members of the Bonvue Irrigation Association Board shall oversee the distribution of water and all engineering of water distribution laterals will be under the sole jurisdiction and control of the Bonvue Irrigation Association Board.
- All engineering and construction of water distribution systems from the laterals to the individual member's property shall be the responsibility of the property owner. The ditch rider or Bonvue Irrigation Association Board may be consulted for engineering and construction ideas, but will have no obligation for the design, construction, performance or maintenance of the member's irrigation system. All maintenance of water distribution systems from the laterals to the individual member's property shall be the sole responsibility of the member or property owner.
- One outlet will be allowed per lot. Said outlet is to be a maximum of four inches in diameter from the lateral to the members' sump or pump intake. Taps into the bottom of the lateral pipelines will not be allowed.
- Tapping into a lateral pipeline or working on a lateral shall not be performed during the irrigation season so as not to interrupt service to downstream members.
- Restrictions may be placed in any outlet at the discretion of the ditch rider or Bonvue Irrigation Association Board.
- No pumping, siphoning, or trenching from the main laterals will be allowed. Water may be obtained from laterals only by tapping into a lateral and routing a pipe, etc. to a sump or pump intake on the members' property.
- In the event that a lateral is an open ditch across a members' property, a 4-inch wide by 4-inch deep trench may be routed from the open lateral to a sump or pump intake on the members' property. The trench must include a mechanism, at the lateral, to shut off water flow from the lateral to the members' trench. Pumping directly out of the lateral is not allowed.
- It should be noted that the water in McIntyre Gulch is not the property of Bonvue Irrigation Association.
- No pumps larger than 1-horsepower will be allowed.
- No blocking, backing or otherwise impeding the natural flow of the laterals will be permitted.
- No water will be delivered to any user except those within the three foot easement that is permitted for the Bonvue Irrigation Association.
- The homeowner is responsible for:
- Contacting a Bonvue Irrigation Association board member and identifying the location of all nearby Bonvue Irrigation Association lines prior to the start of any construction or remodeling on their property.
- Notifying all contractors working on their property of the location of the Bonvue Irrigation Association lines.
- Damages to and repair of any Bonvue Irrigation Association line during the course of construction or remodeling on their property.
- Any member who is two years delinquent in paying annual dues will be sent an annual statement at the beginning of the following irrigation season. The delinquent member will have 30 days after mailing of the annual statement, to pay all past due and the current year dues. If payment is not received after 30 calendar days, the delinquent member will be dropped from membership. If the delinquent member desires to re-join the association after being dropped, all past due bills must be paid in full, and the standard tap-on fee of $200/share will be assessed.
If after being dropped from membership, the delinquent member is found to be irrigating using Bonvue Irrigation Association water, the delinquent members tap into the Bonvue Irrigation Association lateral will be physically and permanently removed.
- The Bonvue Irrigation Association Board reserves the right to waive any or all the regulations in any instance or special case.
Notice
According to the Bonvue Irrigation Association Bylaws (Revised March 5, 1996), Article I - Members and Membership Rights, Section 5:
"The rights of membership may be suspended by the Board of Directors for violations of regulations prescribed by the Board of Directors regarding the distribution and use of water by the Members of this Association and the maintenance and use of the ditches, reservoirs and other facilities of this Association, for such period as the Board of Directors may decide not exceeding one irrigation season, provided that such suspension may be withdrawn by a majority vote at any annual or special meeting of the Members of this Association.
The rights of membership also may be suspended by the Board of Directors for failure of that Member to pay any delinquent annual or special assessment levied under the provisions of these Bylaws, until such assessment, including penalty, shall have been paid. No Member whose membership has been suspended shall be entitled to any rights as a Member of this Association during the period of such suspension."
